Appellate Brief Filed Challenging Arbitration in Commercial Property Case

We have just filed our appellate brief in a commercial property case between two brothers-in-law and former business partners challenging whether the parties should have been sent to arbitration.  The case styled Blue Water Bay at Center Hill, LLC, et al. v. Larry J. Hasty, et al., involves, among other issues, whether the parties were subject to arbitration based on a guaranty agreement limiting the scope of arbitration, and if our client should have been, at a mininum, afforded the right to take discovery on arbitrability.
